Retail cannabis stores

On January 21, 2019, Town Council voted to allow retail cannabis storefronts in Halton Hills. You can read the results of the public consultation regarding retail cannabis storefronts.

The Alcohol and Gaming Commission of Ontario is the province’s official registrar to oversee the licensing and regulation of retail stores. More information regarding the public notice for Cannabis Retail Store Authorization is available on the AGCO website.

Cannabis production notification process

Health Canada licenses the production of cannabis across Canada, resulting in approved licensed producers (LPs). To get a licence to operate a production facility, you must apply to Health Canada in accordance with federal legislation.
Health Canada requires that you provide written notice to a senior official of the local government, fire authority and police force. The Town of Halton Hills reviews these notifications. Licence holders must follow all applicable By-laws including zoning and fire regulations.

Upon receipt of notifications, the Town will notify the Fire Department, but you must provide separate written notice to Halton Regional Police Services. 

The following three steps outline the cannabis notification process:

1. Include the following items in your notification, as required by Health Canada:

1. Name

2. Date on which you expect to submit the application

3. Class and subclass of licence that you need and the activity that  you expect to conduct under the licence

4. Address of the site where you propose to conduct the activities and, if applicable, of each building within the site

2. Submit the notification in one of the following ways:

1. By email to Clerk & Director of Legislative Services, Suzanne Jones.

2. In person at Service Halton Hills, located at Town Hall, 1 Halton Hills Drive

3. By mail to Clerk & Director of Legislative Services, 1 Halton Hills Drive, Halton Hills, Ontario, L7G 5G2.

3. The Town will acknowledge receipt of notifications.

Without the required information above, the notification is not considered complete.
A phone call is not an acceptable form of notification.

Recreational cannabis use

Bill C-45, the Cannabis Act, provides for legal access to cannabis. It addresses the control and regulation of cannabis production, distribution and sales. The Cannabis Act and its Regulations came into force on October 17, 2018. In Ontario, the Act provides for the legalized use of cannabis with specific provisions including:

• The minimum age for consumption is 19

• The Smoke-Free Ontario Act allows residents to use cannabis wherever tobacco smoking is allowed

• A maximum of four plants per household may be grown

Cultivation and processing

On July 8th, 2019 Halton Hills Council passed By-laws 2019-0034, 2019-0035, and 2019-0036 to regulate cultivation and production within the Town. For information on the purpose and effect of the By-laws, implementation and appeals, please see Notice of Passing.

Medical cannabis use

Under the Cannabis Act, patients authorized by their health care provider can use cannabis for medical purposes.
